Rule Number : 7-0 : PAYMENT OF FREIGHT CHARGES
A. -Unless otherwise specifically provided, all freight and other charges may be prepaid in the United States in United States Currency or may be prepaid at destination in United States Currency or its equivalent in local currency. Collect shipments may be accepted only with prior approval from the Carrier. Requests for collect shipments must be made at the time freight is booked as stated on the Bill of Lading. No collect shall be applicable on Used Household Goods/Personal Effects, Privately Owned Automobiles or Refused/returned Shipments.Cargo will only be released upon presentation of an original Bill of Lading and the payment of freight; demurrage or other charges are paid to the Carrier.Both Shipper and Consignee of the goods or articles shipped shall be liable jointly and severally for all unpaid charges payable on account of a shipment pursuant to applicable Tariff including, but not confined to, sums advanced or disbursed by Carrier on account of such shipment. Once shipment is tendered and in transit, charges cannot be changed from prepaid to collect or From collect to prepaid or any combination thereof.Ocean freight and other tariff charges are due and completely earned upon receipt of cargo by the Carrier, ship and/or cargo lost or not lost.Payer’s Liability: Payment of all or any part of the freight to a Freight Forwarder, a Broker or any other person, other than the Carrier or its authorized agent, shall not be deemed payment to the Carrier and shall be made at payer’s sole risk. Any such person shall be deemed to be an agent of the Shipper and not of the Carrier in respect of its receipt or payment of funds.
B. –COLLECTION: The Shipper and Freight Forwarder and Consignee shall be jointly and severally liable to the Carrier for all costs incurred in collection of sums due the Carrier under this Tariff, including, but not limited to court costs, expenses or attorney’s fees incurred in investigating or filing any claim relating there to.
