Rule Number : 9-0 :FREIGHT FORWARDER COMPENSATION PAYMENT OF COMPENSATION – SOUTHBOUND ONLY(From U.S.)
A. -Compensation to a licensed ocean Freight Forwarder will be paid on the ocean segment of the transportation only to the extent of the value rendered in connection with any shipment dispatched on the behalf of others when, and only when, such Forwarder is licensed with the Federal Maritime Commission under Section 19 (a) of the Shipping Act of 1984 and has certified in writing that it holds a valid license and has performed with respect to such shipment the solicitation and securing of the cargo or the booking thereof, or otherwise has arranged for space for such cargo and has performed at least two of the following services :
1. -Engaged, booked, secured, reserved, or contracted directly with the Carrier or its Agent for space aboard a vessel or confirmed the availability of that space.
2. -Prepared and processed the ocean Bill of Lading, Dock Receipt, or other similar document with respect to the shipment.
3. -Preparation and processing of dock receipts and delivery orders.
4. -Prepared and processed consular documents and export declarations; and
5. -The payment of ocean freight charges on such shipments.
B. -Carrier will not pay compensation for services described in Paragraph A. more than once for the same shipment.
C. -Carrier will not knowingly pay compensation on a shipment in which the Forwarder has a direct or indirect beneficial interest.
D. -EXCEPTIONS : Compensation will not be due or payable on the following :
Advance Charges
Temporary freight charges or Emergency Surcharges
Bulk Cargoes and Lumber exempted from the filing requirements of the Shipping Act of 1984.
Currency Adjustments
Military Sea lift Command or Military Traffic Management Command Cargoes.
E. -Compensation shall be paid on all South Bound Cargo as follows : 2.50 percent the Basic Ocean Freight on Full Container Loads (FCL), and 5.00 percent of the Basic Ocean Freight on Less Than Container Loads (FCL)
