Rule Number : 25-0 : CERTIFICATION OF SHIPPER STATUS IN FOREIGN COMMERCE
A. -Every Shipper shall clearly declare its status as owner of the cargo, Freight Forwarder, N.V.O.C.C., Shipper Association, Shipper’s Agent, or other category as applicable when cargo is booked with, or tendered to, the Carrier for transportation service. Carrier shall place such status, along with the Shipper’s name and address, in the Shipper Identification Box of the Bill of Lading when the Bill of Lading is issued. When a Freight Forwarder, Shipper, or other party prepares Carrier’s Bill of Lading, such status MUST be shown clearly and legibly in the Shipper Identification Box of the Bill of Lading or the Carrier will refuse to forward the shipment until the Shipper’s status is clarified and the Bill of Lading is amended.
B. -If the Shipper declares itself to be a Non-Vessel operating common carrier, the N.V.O.C.C. MUST furnish the Carrier with a copy of its Surety Bond and the Title Page of its applicable Tariff on file with Federal Maritime Commission, or in lieu thereof, a copy of Rule 24 of its applicable tariff. Any such documents furnished to the Carrier MUST be in effect by the date cargo is tendered to the Carrier for transportation. If the N.V.O.C.C. has furnished such documentation to the Carrier at any time during the previous six (6) months this requirement will be waived.
C. -If the Shipper declares itself to be a Shippers’ Association, the party booking the cargo, or the documentation furnished when the cargo is tendered to the Carrier, MUST specify whether or not the member for whom transportation service is to be provided is an N.V.O.C.C.
